The Investigation Committee preferred a formal complaint against Miss M. Mack of Belcanto, 69 Riverview Grove, Strand-on-the-Green, London W4 3QP. Prefix: BELCANTO.
That the Defendant is in breach of Articles 12(1)(a) and/or 12(1)(b) (paragraph 1) and/or 12(1)(d) of the GCCF Constitution in that:
1. On 18 October 2004, the Defendant sold to Mrs Matlow a female Lilac Burmese kitten, BELCANTO LILAC PRINCESS, date of birth given as 26 June 2004. The vaccination certificate provided by the Defendant had been altered in a number of ways.
2. The Defendant supplied an unsigned pedigree certificate for BELCANTO LILAC PRINCESS which was not completed in accordance with GCCF Rules, Section 1, Rule 10a. The pedigree showed the dam to be BELCANTO SENA JURINAC, not BELCANTO TITANIA, as shown on the registration document.
By these actions the Defendant acted in a way that was discreditable and prejudicial to the welfare of cats or the interest of cat owners or the breeding or exhibiting of cats, within the meaning of the said articles.
Miss Mack did not attend the hearing, nor was she represented.
No plea was received from Miss Mack.
The Investigation Committee called one witness.
The Disciplinary Committee found the complaint against Miss Mack proved, and by a majority decision, ordered that she be suspended for a period of two years within the meaning of Article 12(4)(b)(i).
The Disciplinary Committee also ordered that Miss Mack be fined an amount of £350, such fine to be paid within 28 days, within the meaning of Article 12(4)(c)(ii) of the GCCF Constitution.
The Disciplinary Committee directed that Miss Mack pay the sum of £150 by way of costs.
The Investigation Committee preferred a formal complaint against Mrs C. and Miss J. Richards of 41 Park Close Road, Alton, Hampshire GU34 2EZ. Prefix: TONKAHOLICS.
That the Defendants are in breach of Articles 12(1)(a) and/or 12(1)(b) (paragraph 1) and/or 12(1)(d) of the GCCF Constitution in that:
On 10 January 2004 they sold a Caramel Tabby Tonkinese male kitten, TONKAHOLICS DARCY, date of birth 2 July 2003, to Miss C. Mackenzie. They knew, or should have known, that the kitten was unfit for sale, as when he was examined by a veterinary surgeon on 15 January 2004, he was found to be suffering with a purulent rhinitis. Tests revealed that he had a nasal infection of inter alia Pasteurella multocidea, Escherichia coli, Bacteroides and Clostridium, and also a middle ear infection which may require surgery. There had been erosion of the nasal turbinate bones. DARCY will always have these opportunistic infections and will never be able to lead a normal life. DARCY has been prescribed antibiotics virtually continuously since 15 January 2004. In the opinion of the veterinary surgeon, the clinical signs would have been present long before Miss Mackenzie acquired him, and the previous owners would have been aware that he had a nasal problem.
By this action the Defendants acted in a way that was, or may have been discreditable and/or prejudicial to the welfare of the kitten and/or the interest of cat owners.
Mrs Richards attended the hearing and also represented Miss Richards.
Mrs and Miss Richards denied the complaint.
Mrs Richards called one witness.
The Investigation Committee called two witnesses.
The Disciplinary Committee found the complaint against Mrs and Miss Richards proved by a majority, and ordered that they be censured and warned, within the meaning of Article 12(4)(c)(i) of the GCCF Constitution.
The Disciplinary Committee directed that Mrs and Miss Richards pay the sum of £300 by way of costs.
